1. Acceptance of Terms

By accessing or using the Highland Digital LLC website at highlanddigital.net, submitting an inquiry form, booking a demo call, or engaging with our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

2. Services

Highland Digital LLC provides digital marketing services to small businesses, including marketing automation setup, AI-powered communication tools, website design and hosting, review management, and ongoing campaign management. We are headquartered in Lincoln, Nebraska and primarily serve businesses in the home services and contracting industries in Wichita, Kansas and surrounding regional markets.

Submitting a contact form or booking a demo does not constitute a binding service agreement. All services are subject to a signed service agreement, package selection, and payment confirmation.

3. SMS and Text Message Communications

By providing your phone number and consenting to receive text messages from Highland Digital LLC, you agree to the following:

• Transactional messages: You may receive SMS messages related to your inquiry, demo scheduling, onboarding, and service updates.
• Marketing messages: If you have explicitly opted in to marketing communications, you may receive promotional messages including service announcements and offer updates.
• Opt-out: You may opt out of SMS messages at any time by replying STOP. You will receive one confirmation message and no further SMS communications.
• Help: Reply HELP to any message for assistance, or contact us at [email protected].
• Message frequency: Varies based on your inquiry and service engagement. Typical contacts receive 2–8 messages during an active inquiry or onboarding period.
• Message and data rates: Standard message and data rates may apply depending on your mobile carrier and plan.
• No sharing: We do not share your phone number or SMS opt-in consent with third parties for their own marketing purposes.

4. Service Agreements and Billing

Ongoing services are billed on a monthly basis. Pricing is based on the package selected at signup. A $297 cancellation fee applies if a client cancels within 90 days of onboarding. This fee exists to protect the cost of setup, website build, and initial system configuration provided at the start of service.

Month-to-month service continues until cancelled. Cancellation requests must be submitted in writing via email to [email protected] with at least 7 days notice before the next billing cycle.

5. Accuracy of Information

We strive to ensure all information on our website — including service descriptions, pricing, and package details — is accurate and current. Pricing and available features are subject to change and will be confirmed in your service agreement at the time of signup.

6. User Responsibilities

When using our website or engaging with our services, you agree to:

• Provide accurate and complete information when submitting forms or entering into service agreements
• Use our services only for lawful business purposes
• Not misrepresent your business or its intended use of the services
• Not attempt to interfere with or disrupt our website, platform, or systems

7. Intellectual Property

All content on this website — including text, images, logos, and design elements — is the property of Highland Digital LLC or its licensors and is protected by applicable copyright and trademark law. Campaign templates, workflows, and system configurations created by Highland Digital for client use remain the intellectual property of Highland Digital LLC unless otherwise specified in a written agreement.

8. Third-Party Platforms

Our services are delivered primarily through GoHighLevel (GHL), a third-party SaaS platform. We are not responsible for service interruptions, platform changes, or policy updates originating from GoHighLevel or other third-party tools used in service delivery. Your use of any third-party platforms connected to our services is subject to those platforms' respective terms and policies.

9. Limitation of Liability

To the fullest extent permitted by law, Highland Digital LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or services. Our total liability for any claim shall not exceed the amount you paid for the specific services giving rise to the claim in the 30 days preceding the claim.

We do not guarantee specific business outcomes, revenue results, or performance metrics. Marketing results vary by industry, market, and business factors outside our control.

10. Disclaimer of Warranties

Our website is provided "as is" without warranties of any kind, express or implied. We do not warrant that our website will be uninterrupted, error-free, or free of security vulnerabilities.

11. Governing Law

These Terms of Service are governed by the laws of the State of Nebraska, without regard to its conflict of law provisions. Any disputes arising from these terms shall be subject to the jurisdiction of the courts of Lancaster County, Nebraska.
